This Copyright Policy outlines how MaintainRentals handles copyright infringement claims under Canadian copyright law and international treaties.

1. Overview

MaintainRentals Inc. ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This DMCA Policy describes how we handle notices of alleged copyright infringement and how users can submit counter-notifications.

This policy is intended to implement the procedures set forth in 17 U.S.C. ยง 512 and the Digital Millennium Copyright Act ("DMCA") for the reporting of alleged copyright infringement.

2. DMCA Notice Requirements

To submit a valid DMCA notice of alleged copyright infringement, you must provide our designated Copyright Agent with the following information in writing:

Required Information
  • Identification: Your full name, address, telephone number, and email address
  • Signature: Physical or electronic signature of the copyright owner or authorized representative
  • Copyrighted Work: Identification of the copyrighted work(s) claimed to be infringed
  • Infringing Material: Identification of the material that is claimed to be infringing, including URLs
  • Location: Information reasonably sufficient to permit us to locate the material
  • Good Faith Belief: Statement that you have a good faith belief that the use is not authorized
  • Accuracy Statement: Statement that the information in the notice is accurate
  • Authority Statement: Statement that you are authorized to act on behalf of the copyright owner
Important: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages.

3. How to Submit a DMCA Notice

Submission Guidelines
  • Use "DMCA Notice" as the email subject line
  • Include all required information listed above
  • Attach supporting documentation if available
  • Allow 5-10 business days for processing

4. Our Response to DMCA Notices

Upon receipt of a valid DMCA notice, we will:

Initial Review
  • Review the notice for completeness and validity
  • Reject incomplete or invalid notices with explanation
  • Acknowledge receipt within 5 business days
Content Removal
  • Remove or disable access to allegedly infringing material
  • Notify the affected user of the removal
  • Process removal within 2 business days of validation
User Notification
  • Inform the user about the DMCA notice
  • Provide copy of the DMCA notice
  • Explain counter-notification process

5. Counter-Notification Process

If you believe your content was removed in error, you may submit a counter-notification:

Counter-Notification Requirements
  • Your full name, address, phone number, and email address
  • Physical or electronic signature
  • Identification of the removed material and its original location
  • Statement under penalty of perjury that removal was in error
  • Consent to federal court jurisdiction in your district

  • Submit within 10 business days of receiving our notification

6. Restoration of Content

Upon receipt of a valid counter-notification:

Review Process
  • Review counter-notification for completeness
  • Forward counter-notification to original complainant
  • Allow 10 business days for complainant response
Content Restoration
  • Restore content if no legal action is initiated
  • Restore within 10-14 business days of counter-notification
  • Notify both parties of the restoration
Legal Action
  • Keep content removed if complainant files lawsuit
  • Complainant has 14 days to file legal action
  • Notify user if legal action is filed

7. Repeat Infringer Policy

We maintain a policy regarding repeat copyright infringers:

Account Monitoring
  • Track DMCA notices and violations per account
  • Maintain records of infringement history
  • Flag accounts with multiple violations
Consequences
  • First Violation: Warning and content removal
  • Second Violation: Temporary account suspension
  • Third Violation: Permanent account termination
Appeals
  • Submit appeals to copyright@maintainrentals.com
  • Appeals reviewed within 10 business days
  • Decision based on violation history and circumstances
