These Terms of Service ("Terms") govern your use of the MaintainRentals platform and services. By using our platform, you agree to these Terms.

1. Acceptance of Terms

By accessing or using MaintainRentals ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Platform.

These Terms constitute a legally binding agreement between you and MaintainRentals Inc. ("Company," "we," "us," or "our").

2. Description of Service

MaintainRentals is a comprehensive property management platform that provides:

  • Property Management: Tools for managing rental properties, units, and tenant relationships
  • Tenant Management: Application processing, lease management, and tenant communication
  • Payment Processing: Rent collection, payment tracking, and financial reporting
  • Maintenance Coordination: Work order management and vendor coordination
  • Document Management: Lease generation, document storage, and e-signature integration
  • Reporting & Analytics: Financial reports, occupancy tracking, and performance metrics

3. User Accounts and Registration

Account Types
  • Administrators: Full access to all platform features and settings
  • Property Owners: Access to manage their properties, tenants, and financial data
  • Tenants: Access to lease information, payment history, and property communications
  • Applicants: Limited access for application submission and review
Registration Requirements
  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate and current
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized use of your account

4. User Responsibilities

Property Owners
  • Ensure all property information is accurate and up-to-date
  • Comply with all applicable fair housing laws and regulations
  • Maintain properties in safe and habitable condition
  • Respond to maintenance requests within reasonable timeframes
  • Provide legally compliant lease agreements
Tenants
  • Pay rent and other charges on time
  • Report maintenance issues promptly
  • Maintain the property in clean and sanitary condition
  • Comply with lease terms and community rules
  • Notify property owner of extended absences
All Users
  • Use the Platform only for lawful purposes
  • Do not attempt to gain unauthorized access to other accounts or systems
  • Communicate respectfully and professionally with other users
  • Respect the privacy and confidentiality of other users' information

5. Payment Terms

Service Fees
  • Property owners are responsible for all applicable service fees
  • Fees are billed monthly in advance
  • Payment is due within 15 days of invoice date
  • Late payments may incur additional charges
Rent Collection
  • Platform facilitates rent collection but is not a party to lease agreements
  • Processing fees may apply to electronic payments
  • Funds are typically available within 3-5 business days
  • Returned payments may result in additional fees
Refunds
  • Service fees are non-refundable except as required by law
  • Refunds for unused service periods may be available at Company's discretion
  • Refund requests must be submitted within 30 days of the charge

6. Document and Signature Services

Our electronic signature services comply with applicable e-signature laws:

  • Electronic signatures are legally binding and enforceable
  • All signature processes include audit trails and timestamps
  • Documents are encrypted and securely stored
  • Access to signed documents is maintained for legal retention periods

7. Prohibited Uses

You may not use the Platform to:

  • Violate any applicable laws, regulations, or third-party rights
  • Impersonate any person or entity or misrepresent your affiliation
  • Upload malicious code, viruses, or harmful components
  • Interfere with or disrupt the Platform's security or functionality
  • Attempt to gain unauthorized access to other accounts or systems
  • Overload, flood, or spam the Platform with excessive requests
  • Harass, threaten, or abuse other users
  • Use the Platform for commercial purposes without authorization

8. Intellectual Property

The Platform and its content are protected by intellectual property laws:

  • Our Rights: We retain all rights to the Platform, software, and related technology
  • License: We grant you a limited, non-exclusive, non-transferable license to use the Platform
  • User Content: You retain rights to content you upload, but grant us a license to use it
  • Trademarks: MaintainRentals and related marks are our trademarks

9. Disclaimers and Limitations

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding availability, reliability, or accuracy of the Platform
  • Warranties regarding security or freedom from harmful components

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

10. Termination

We may terminate or suspend your account immediately for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • Prolonged inactivity

You may terminate your account at any time by contacting customer support.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved through:

  • Informal negotiation first
  • Mediation through Ontario dispute resolution services
  • Ontario courts of competent jurisdiction as a last resort
Consumer Protection: Ontario consumers may also contact the Ministry of Government and Consumer Services for dispute resolution assistance.

12. Changes to Terms

We may modify these Terms at any time by:

  • Posting the updated Terms on the Platform
  • Notifying you via email or Platform notification

Your continued use of the Platform after changes constitutes acceptance of the new Terms.
